The 19-year-old victim was allegedly tortured and gang raped by four men on 14th September in UP’s Hathras district. Her tongue was cut to ensure she did not give any statement. She succumbed to her injuries on 28th. It is stated that her family was not allowed to cremate her body.
The Lucknow Bench of Allahabad High Court has taken Suo moto cognizance of the Hathras Gang Rape. The Bench of Justices Jaspreet Singh and Rajan Roy has issued notices to the state of U.P through Additional Chief Secretary, Director General of Police. UP, Hathras Lucknow District Magistrate, Hathras Superintendent of Police, and has requested them to be present before the Court on the next date of hearing which is October 12.
It is stated that they shall put forth their version with support of necessary material and shall also explain the Court about the status of the investigation relating to the crime against the victim. The Court has also requested the victim’s family to hear their version. The authorities have been directed to ensure that no influence or pressure is exerted upon the family members of the deceased in any manner by anyone.
The court stated that if these reports are true then it would be a case of “gross violation of basic human and fundamental rights” under Article 21 and Article 25. It is stated that certain officers of the state government has given a statement in the newspapers and media that the cremation took place with the consent of the family.
The Court concluded by saying that it is the matter of public importance as it violates the fundamental rights of the victim and the family.
