Use of jail premises for committing crimes lead to serious threat to the members of society

The Allahabad High Court heard an anticipatory application filed on behalf of an applicant, Imran The allegations made against the applicant were unauthorised entry in jail, Deori and the commission of serious cognizable offence inside the cell of a jail against an inmate.
It was alleged in FIR that the victim was abducted from Prayagraj and was taken to the District Jail, Deori where he was assaulted inside the jail cell. Though the counsel for the applicant stated that the applicant did not visit Jail and was busy attending a marriage ceremony in Prayagraj and even his location on phone showed he was present in Prayagraj. The incident took place much earlier while the FIR was filed after a month. It was stated that complete freedom was granted to the investigation officer to carry out his task in the nature of allegations.
The AGA appearing on behalf of the State also pointed out that the applicant had a criminal history of three cases. After hearing the argument from both the sides. The court held that the applicant was not one of the 5-6 persons who went inside the district jail. It also stated that the time taken by the victim to act and to lodge FIR could only be described in jail. As a result of which the anticipatory application was rejected.
