Plea in Gujarat High Court seeks public disclosure of information on functioning of Gujarat Legislative Assembly

A Public Interest Litigation was filed in the matter of making necessary information discussed in Legislative Assemblies available on their website through regular updates in the Gujarat High Court. Pertaining to this the High Court send a notice to the Gujarat Legislative Assembly. The notice sent to the Assembly was issued by a Bench comprising of Justices JB Pardiwala and Ilesh Vora. They seeked a response to the above mentioned writ petition in public interest. The public spirited petitioner, Neeta Dattataraya Hardikar approached the High Court to file this petition asking for regular updates about the necessary and relevant information on the Assembly’s website under the Right to Information Act, 2005. Live telecast, text of legislations including subordinate legislations, information about the different Committees and their subsequent reports, rules, regulations, instructions, manuals and records, telecasts of past proceedings along with their transcripts and copy of the documents that were held in control were the points that were prayed to be disclosed in the petition. If any of the documents could not be revealed ‘in public interest’, the Assembly could claim legislative privilege, it was additionally argued. 17th February, 2021 is the date that was assigned to the Assembly by the High Court for their response. For the petitioner, Senior Advocate Prakash K Jani and advocate BS Soparkar appeared.
